The terms Ukraine Hygiene Document or Ukraine Hygiene Certificate are, in practice, a general description used for products that need to be assessed in terms of human health and product safety.
However, it is not correct today to speak of a single type of “Hygiene Certificate” that is automatically mandatory for all products in Ukraine. Which document or conformity assessment a product is subject to is determined by the nature of the product, its intended use, its composition and the technical regulations that must be applied in Ukraine.
Although the concepts of the sanitary-epidemiological / hygienic certificate and the sanitary-epidemiological expert conclusion inherited from the past exist in Ukrainian legislation, in current practice the procedure to be applied must be assessed separately for each product. In Ukrainian legislation, these documents are associated with determining the safety of certain products for human health on the basis of research and assessment results.
For Which Products May the Ukraine Hygiene Document Come Up?
If the product is directly or indirectly related to human health, the relevant legislation and technical requirements in Ukraine may need to be examined.
For example, a product-based safety and conformity assessment may be carried out for:
- Food products,
- Food contact materials and packaging,
- Cosmetics and personal care products,
- Children's products,
- Textiles and consumer products,
- Furniture and certain household products,
- Certain materials used in production,
- Products containing chemical substances or components,
- Various consumer products that may affect human health
Important: It is not correct to make a general ruling that “obtaining a Ukraine Hygiene Certificate is mandatory” automatically for all of the product groups above. The requirement must be determined on the basis of the product's characteristics and the current Ukrainian legislation it is subject to.
How Is the Ukraine Hygiene Certificate Obtained?
If it is determined that a hygienic or sanitary assessment is required for the product, the product's technical and composition information is examined first.
In general, the process may consist of the following stages:
1. Determining the product scope
The product's name, intended use, composition and technical characteristics are examined.
2. Determining the Ukrainian legislation
The technical regulations, hygienic requirements and relevant special legislation the product is subject to are researched.
3. Reviewing technical documents
The product's technical data sheet, composition information, safety data sheets, instructions for use and existing test reports are assessed.
4. Determining the need for samples and tests
Depending on the nature of the product, laboratory tests or other conformity assessment operations may be required.
5. Conformity / hygiene assessment
It is assessed whether the product meets the relevant Ukrainian requirements.
6. Issue of the required document
The required conformity document, assessment conclusion or relevant official documentation is prepared according to the legislation the product is subject to.
Hygiene and Safety Requirements for Food Products
For food products, the process must be handled differently from other consumer products.
Ukrainian legislation provides for the application of certain sanitary measures and technical requirements through risk analysis, control and production processes in terms of food safety. The definition of the state sanitary-epidemiological expert conclusion on food safety in Ukrainian legislation also reflects this approach.
For this reason, instead of looking only for a “hygiene certificate” for food products, the following should be assessed together:
- The product's status under food legislation,
- Its composition and ingredients,
- Labelling,
- Food safety requirements,
- Production and import conditions,
- Required registration, notification or conformity procedures
Hygiene and Safety for Cosmetic Products
For cosmetic products too, the product's status under current legislation in Ukraine must be determined.
The procedure to be applied can be determined on the basis of information such as the product's:
- Composition,
- Intended use,
- Classification as a cosmetic,
- Label information,
- Safety assessments,
- Manufacturer's documentation
For this reason, it should not be assumed that a document or test report existing in the European Union automatically replaces the same document in Ukraine. Existing documents must be assessed separately against Ukrainian requirements.
The Hygiene Document in Ukrainian Customs Procedures
The documents that customs or the relevant inspection authorities may request during import may vary according to the product group and the legislation in force.
For this reason, instead of using a general statement such as “a Hygiene Certificate is mandatory for all products to clear Ukrainian customs”, it is safer to determine the document requirements in advance on the basis of the product's HS code, technical characteristics and intended use.
